We, SMARTFIX,INC. (“us”, “we”, or “our”) and its affiliates operate the following online services:

www.smartfixus.com - SmartFix’s Official Website (the “SmartFix Site”); and related mobile applications (the ‘SmartFix: Home Solutions’ App and the ‘SmartFix for Service Providers’ App). The Sites and Apps are collectively referred to as the “Services”. This Privacy Policy applies to all SmartFix’s Services.

We are committed to protecting your privacy and this outline below, as may be updated from time to time (the “Privacy Policy”), explains what information is collected, how it is used, what rights you have, and what choices you may make regarding your personal information. This Privacy Policy applies to all personal information collected by us, whether through the Sites or the Apps, as well as during any written, electronic, and oral communication between you and us.

Your access to and use of our Services are subject to our Terms of Service and this Privacy Policy. Please make sure that you have carefully read and understand the Terms and Service and this Privacy Policy before you use our Services. By using our Services, you accept the Terms of Service, and accept our privacy practices described in this Privacy Policy. If you do not agree with any part of this Terms and Service and this Privacy Policy, you must not use or access our Services.

1. COLLECTION OF INFORMATION

While using our Website, we may ask you to provide us with certain personal information, specifically described below: 

1. Personally Identifiable Information (PII). PII is specific information that can be used to identify, locate or contact you. Such PII may include, but not limited to your name, company name, address, email address, phone, and other contact information. The amount and type of information that we gather may vary depending on the nature of your interaction with the Website and Apps.

2. Non-Personally Identifiable Information (NPII). NPII is information other than PII, including aggregate information derived from PII, that may allow for singling out individual behaviors without directly identifying the individual e.g. device ID, online identifiers (e.g. cookie ID, mobile advertising ID, IP address) or any other technical identifiers. Such information also include what we record in our server logs typically made available by your web browser when you use or access the Website, for instance, browser type, date/time of visit, IP address, computer information, operating system, referrer addresses, and other generally-accepted log information.

2. USE OF INFORMATION

We use your Personal Information to:

• Help protect the safety of the Website and our users, which includes blocking suspected spammers, addressing abuse, and enforcing the Updated Terms and Conditions of Use;

We also may disclose your information when we have reason to believe that someone is or may be causing injury to or interference with our rights or property, or anyone who could be harmed by such activities.

3. LOG DATA

Like many website operators, we collect information that your browser sends whenever you visit our Website (“Log Data”).  This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Website that you visit, the time and date of your visit, the time spent on those pages and other statistics.  In addition, we may use third party services such as Google Analytics that collect, monitor, and analyze such data.

Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a Website and stored on your computer’s hard drive.

We have no control over, and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

7. SOCIAL SHARING

Our Services may offer social sharing features or other integrated tools that let you share content or actions you take on our Services with other media. Your use of these features enables the sharing of certain information with your friends or the public, depending on the settings you establish with the third party that provides the social sharing feature. 8. DO NOT TRACK

Do Not Track (“DNT”) is a privacy preference that you can set in most web browsers. We support DNT in our Services. There is no accepted standard on how to respond to web browsers’ DNT signals. When you have DNT enabled, we may still use information collected for analytics and measurement purposes or to otherwise provide our Services, but we will not load any third-party trackers. You may, however, opt out of having information about you collected and used for behavioral advertising purposes, as described above.

9. CHILDREN’S PRIVACY

Although we welcome users from all walks of life, our Service is not intended or directed at individuals under the age of 13. Therefore, individuals under the age of 13 may not create an account or otherwise access or use the Services.

We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you are aware that your Children have provided us with Personal Information, please contact us. If we discover that a Children under 13 has provided us with Personal Information, we will delete such information from our servers immediately.

10. CHANGES TO THIS PRIVACY POLICY

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

11. CALIFORNIA DATA RIGHTS AND PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

As a resident of California(as defined by the CCPA), you are granted specific rights regarding your personal information, as stipulated below. These rights are subject to certain exceptions, and there may be circumstances where we are allowed by law to decline your request.

• The purposes for collecting or potentially selling personal information.

If at any point we sell your personal information, you have the full right to opt-out of such a sale.

Non-Discrimination Guarantee

You are guaranteed the right to exercise the aforementioned rights without any discriminatory repercussions, such as diminished service quality or illegal pricing modifications.

In processing your requests, we must verify that you are a resident of California and confirm your identity. For this, you may be required to provide government-issued identification. You also have the right to designate an authorized agent to make requests on your behalf; however, this will necessitate a valid power of attorney, and government-issued identification for both you and your agent. Requests lacking sufficient detail for us to fulfill them cannot be processed. 

Global Privacy Control

SmartFix responds to and abides by opt-out preference signals sent through the Global Privacy Control. Any opt-out preferences you exercise through these methods will apply only to the specific device or browser on which you made them. California Shine the Light Disclosure

If you are a California resident, you may request a list of third parties that have received your information for direct marketing purposes during the previous calendar year. If we have disclosed your information, this list will contain the types of information disclosed, and we will provide this list at no cost. California Do-Not-Track Disclosure

SmartFix is committed to providing you with meaningful choices regarding the information collected on our platform for third-party purposes. However, we do not currently recognize or respond to browser-initiated Do-Not-Track signals, as the Internet industry is still working on Do-Not-Track standards and solutions. Please note that Do-Not-Track is distinct from the Global Privacy Control browser choice mentioned above.
